On October 28, 2016, Tara Moffett will be moderating a discussion, “IDEA Meets Bullying- A Changing Landscape in Special Education Liability” with two other special education attorneys at the New York State School Boards Association’s 20th Pre-Convention School Law Seminar at the Hyatt Regency Buffalo Hotel and Conference Center. This discussion will focus on a recent Second Circuit Court ruling which concluded that bullying of a student with a disability could lead to liability for school districts if such conduct results in a denial of a free appropriate public education (FAPE) to that student, and what changes districts may need to make to address these new concerns in their anti-bullying policies and practices.
